1. Acceptance of Terms
By accessing, registering for, or using the MarketThrob™ platform ("the Service"), operated by The Software Suite™ ("we", "us", or "our"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not access or use the Service.
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated effective date. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
2. Description of Service
MarketThrob™ provides an AI-powered market intelligence platform delivering real-time foreign exchange prices, spot metals prices, economic calendar data, AI-generated market analysis, and curated financial news (collectively, "Market Content"). The Service is provided for informational and educational purposes only.
Not Financial Advice
MarketThrob™ is not a licensed financial adviser, investment adviser, broker, or dealer. Nothing on the platform — including AI-generated analysis, price data, economic calendar entries, news content, or any other material — constitutes financial advice, investment advice, trading advice, or a recommendation to buy or sell any financial instrument. All decisions to trade are yours alone.
3. Subscriptions and Payments
Subscription Plans
Access to the MarketThrob™ platform requires a paid subscription. We offer two billing options for the Global Macro Alpha Pass: a monthly plan at USD $90.00 per month, and an annual plan at USD $864.00 per year.
Payment Processing
All payments are processed by PayPal. By subscribing, you authorise PayPal to charge your selected payment method on the billing schedule you have chosen. You must have a valid PayPal account or PayPal-accepted payment method to subscribe.
Refund Policy
All subscription fees are non-refundable. We do not offer prorated refunds for any unused portion of a subscription period — monthly or annual. You may cancel at any time, and your access will continue until the end of your current paid period. See our full Refund Policy.
Price Changes
We reserve the right to change subscription pricing at any time. Any pricing change will apply only to renewal billing cycles, with at least 30 days' notice provided to existing subscribers.
4. Acceptable Use
You agree not to:
- Share your account credentials or subscription access with any third party
- Reproduce, redistribute, resell, or commercially exploit any Market Content
- Scrape, crawl, or systematically download data from the platform
- Attempt to reverse-engineer, decompile, or interfere with the platform's infrastructure
- Use the platform in any manner that violates applicable law or regulation
- Access the platform to develop a competing service
Violation of these terms may result in immediate account termination without refund.
5. Intellectual Property
All content on the MarketThrob™ platform — including but not limited to the platform design, AI-generated analysis, proprietary data pipelines, trademarks, logos, and the MarketThrob™ brand — is the intellectual property of The Software Suite™ and is protected by applicable copyright, trademark, and trade secret laws. You are granted a limited, non-exclusive, non-transferable licence to access the platform for personal, non-commercial use during your active subscription period.
6. Limitation of Liability
To the fullest extent permitted by applicable law, The Software Suite™ and its owner, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to trading losses, loss of profits, loss of data, or business interruption — arising from your use of the Service or reliance on Market Content, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from or related to the Service shall not exceed the total subscription fees paid by you in the three months immediately preceding the claim.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New York, USA, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New York, USA.
